When planning an extension, understanding who handles the party wall award is crucial. This legal agreement protects both homeowners and building owners during construction projects that affect shared walls or boundaries. Knowing who must organise the award can save time, reduce disputes, and keep your build on track.

What Is a Party Wall Award?

A party wall award is a formal document that outlines how work affecting a shared wall or boundary will proceed. It sets out the rights and responsibilities of both parties involved in the project. This award is essential when building close to or on a boundary line, such as when adding an extension.

The award protects building owners from damage and ensures that the build complies with legal requirements. It also helps avoid costly disputes by clearly defining how the work will be carried out.

Who Must Organise the Party Wall Award?

The responsibility to organise the party wall award usually falls on the building owner who plans to carry out the extension or other work affecting the party wall. This means if you are the homeowner planning the build, you must initiate the process.

Here’s what this involves:

  • Serving a Party Wall Notice: You must notify your neighbours (the adjoining building owners) about the planned work at least two months before starting.

  • Appointing a Surveyor: If the neighbours agree, the process is straightforward. If not, one or more party wall surveyors are appointed to prepare the award.

  • Preparing the Award: The surveyor(s) will inspect the property, agree on the scope of work, and write the award detailing how the build will proceed.

If the neighbours do not respond or dispute the notice, the building owner must still arrange for a surveyor to resolve the issue.

What Happens If Both Parties Agree?

If both homeowners agree to the proposed work and the notice, the award can be a simple agreement without the need for a formal surveyor appointment. This can speed up the process and reduce costs.

However, it is still the building owner’s responsibility to ensure the notice is served correctly and that the agreement is documented.

Why Is It Important for Homeowners to Take Charge?

Taking charge of the party wall award process helps homeowners:

  • Avoid delays in the build due to legal disputes

  • Protect their property and neighbours’ properties from damage

  • Ensure compliance with the Party Wall etc. Act 1996 (in England and Wales)

  • Maintain good neighbourly relations during the project

Failing to organise the award can lead to legal action, fines, or forced removal of unauthorised work.

Practical Tips for Organising the Party Wall Award

  • Start early: Serve the notice well before the planned start date to allow time for responses and surveys.

  • Use a qualified surveyor: Choose a surveyor experienced in party wall matters to avoid mistakes.

  • Keep neighbours informed: Clear communication can prevent disputes and delays.

  • Document everything: Keep copies of notices, agreements, and the award for your records.
