20 Year Dispute Resolved by Duchy Party Wall Surveyors.

Duchy Party Wall Surveying was instructed by a local church to help resolve a 20-year boundary dispute. The dispute was based in Penzance, Cornwall, and it explained that the church had tried to resolve this issue with the neighbour for many years without success.


The dispute involved of land the building that client believed to be theirs; however the neighboring property had built on the land, and the church was unsure of the next. When Duchy Party Wall Surveyors was instructed, we attended the site to get a clearer picture of the situation and worked with the instructed solicitors to achieve the best and quickest result for the client, as they were looking to sell the property. Due to the current dispute, the property could not be sold because of the disagreement. After investigating the building, communicating with the land registry, and examining deeds, the result was that the neighbouring property owned the disputed land. Although disappointing for the client, it means property can now be sold, and there will not be any issues in the sale.


This is a very short example of this particular case, but it shows the importance of having a clear boundary line when selling. If the findings were different and the land was in fact owned by the church, this would have involved party wall awards and a process of discussions and negotiations to protect the client and regain land which was theirs.
